Waiver of Liability, Informed Consent Agreement and Contract Terms
I understand that participation in the Renew and Restore with Movement Art, LLC d/b/a Movement Craft (“Movement Craft”) are provided for the purpose of improving health, wellness, and fitness and can incorporate exercises which may include a focus on any of the following pillars of pain-free movement: mobility stretching for improvement of flexibility and mobility, therapeutic Pilates, whole-body strength, fascia-release, overall movement, as well as a focus on breathing and restorative body work, balance, stress reduction, and/or the balancing/aligning of the body for proper posture. If I experience any type of pain, discomfort, or feel ill during this program, I will immediately inform Movement Craft and cease any physical activity; furthermore, I will not participate in any exercises given to me by Movement Craft if I am experiencing any symptoms of unexpected pain or illness.
I understand that a medical evaluation is advisable before beginning any program of physical conditioning, exercise, and/or movement-based bodywork. I acknowledge that I have either had such a medical evaluation and been given my medical practitioner’s permission to participate in Movement Craft’s program or that I have decided to participate in the program without the approval of my medical practitioner and, in such case, I assume full responsibility for my participation in the program. Further, I have or will continue to keep Movement Craft informed of any physical condition or disability, which would prevent or limit my participation in the program. I acknowledge that, although the program may have substantial physical benefits, Movement Craft does not engage in diagnosing or treating medical diseases or deficiencies, nor does the program serve as a substitute for medical diagnosis or treatment when such attention is needed.
I recognize there is the possibility of negative side effects, including possible short-term aggravation of some symptoms, tiredness, light-headedness, etc. I understand that physical exercise can be a potentially hazardous activity. I also understand that exercise and movement-based activities involve a risk of injury and even death. I acknowledge that I am voluntarily participating in these activities. I accept and assume full responsibility for any side effect, hazards, risks, injuries, or damages, that I might sustain or confront while participating in Movement Craft’s program. I understand that if I do not want to or cannot afford to sustain or confront any such side effect, hazards, risks, injuries, or damages, then I should not sign this waiver and I should not participate in the program with Movement Craft.
In consideration of being allowed to participate in Movement Craft’s program, I hereby irrevocably waive, release, and forever discharge Movement Craft and its owners, employees, contractors, instructors, agents, and representatives from any claims, demands, causes of action, damages, liabilities, and costs and expenses that in any way arise out of or relate to my participation in the program, including, without limitation, claims: (i) for, or on account of, personal injury, death, pain and suffering, property damage, or loss of any kind; (ii) relating to injuries or damages sustained as a result of the sole, joint, or concurrent negligence of the parties being released; or (iii) under any theory, claim, or charge arising under any federal, state, or local laws; provided, however, that the foregoing release does not apply to any claims or statutory right that cannot legally be waived.
By enrolling in the Renew & Restore class, you agree to a recurring membership payment of $49 every 28 days. You may cancel at any time with a minimum of 7 days' notice before your next billing date to avoid future charges. All payments are subject to a Stripe processing fee, and the amount of the fee depends on the card or payment method used. If a refund is requested, we will be happy to process it. Please note, however, that the Stripe processing fee is non-refundable, and as such, your refund will be the amount paid minus the applicable processing fee.
